Terms & Conditions

The undersigned (“Owner”), by this agreement, authorizes Harlowe-Powell Auction Ltd. 434-293-2904 (“Auctioneer”), to sell the following (“Property”) by public Auction as per the general conditions listed below.

  1. Auctioneer will attempt to obtain the highest price possible. The property will be sold to the high bidder without reserve.
  2. Owner will pay Auctioneer commission of:
    • 20% items selling for $101.00 or more
    • 30% items selling for $31.00 to $100.99
    • 40% items selling for $11.00 to $30.99
    • 60% items selling for $10.99 and under
  3. On each item of property sold. A buyer’s premium can/will be charged and retained by the Auctioneer.
  4. Any transportation costs incurred by Auctioneer in moving the property to the auction gallery will be borne by the Owner.
  5. Auctioneer will remit to Owner the net proceeds of the auction (less commission and expenses) within 30 days of final disposal.
  6. Reasonable care will be taken on all goods received. Auctioneer carries fire and burglary insurance. In the event of a loss, if a settlement cannot be agreed upon, an independent appraiser will be retained and his/her decision on the fair auction values less commission and expenses will be binding on both parties. The cost of such appraisal will be shared equally by Owner and Auctioneer.
  7. Owner agrees not to bid on any of his/her own merchandise.
  8. Owner hereby states that he/she is the owner of each item of property, that the property is free and clear of all liens and that the Owner had complete power of sale.
  9. Owner agrees to indemnify and hold Auctioneer harmless from and against any and all Claims, actions, damages, losses, liabilities, and expenses (including reasonable attorney fees) relating to the breach or alleged breach of any Owner’s obligations,representation, or warranties herein. Owner’s representations, warranties, and indemnity herein shall survive completion of the Transaction contemplated by this agreement.
